This Internet website (the “Website”) is provided by Holmewood House School (the “School”) and its authorised associates. Use of the Website is subject to the following Terms and Conditions. The School is free to revise and amend these Terms and Conditions from time to time, any such revisions and amendments being effective from the date of their posting on to the Website.

The School has set up and maintains the Website for the personal information of the User. The School will take no responsibility for damage, to the User’s or any other equipment or software, resulting from use of the Website. The School makes available to the User the provision to download particular documents, on the conditions set out below. By downloading such documents the User is deemed to have accepted these conditions.
1. The Material is provided on the basis that upon downloading the User will conduct such virus scanning and other checks as may be necessary to ensure that the downloaded material will not corrupt in any way his data, software or systems or those of any other person.
2. The User agrees that The School will not be under any liability for any loss or damage including consequential loss or damage however caused, whether by negligence or otherwise, that arises in any way from the use of the downloaded material.
3. If the User provides the downloaded material to another party, then these conditions must be brought to the attention of that other party and the downloaded material must be so provided on the same conditions as those on which the original downloaded material was provided to you by the Holmewood House School website.
Limitation of Liability
To the extent permitted by law, Holmewood House School and its employees, agents and consultants shall not be liable for any loss or damage (including indirect, special or consequential loss or damage) arising out of or in connection with the use of, or reliance on, information available from the Website whether or not caused by any negligent act or omission. If any law prohibits the exclusion of such liability, Holmewood House School limits its liability to the extent permitted by law, to the re-supply of the Information.
Any material transmitted to the Website by the User by electronic mail or other means, including, but not limited to, images of any kind, data, text, questions, answers, comments, suggestions and the like, will be treated as non-confidential and non-proprietary by the School, and by posting material to the Website, the User automatically assigns to the School a royalty-free, perpetual, irrevocable and non-exclusive license to use such material as the School wishes either alone or as a part of other works in any form, media, or technology whether current or future and to sublicense such rights to anyone.
The User agrees that the School may terminate with or without notice the User’s use of the Website if the School reasonably believes that the User has violated the letter or spirit of these Terms and Conditions, or violated the rights of the School or any third party. The User agrees that the School may modify or discontinue the Website and that the School will not be liable to the User or any third party for so doing. The provisions entitled “Users’ Copyright ”, “Disclaimer”, “Limitation of Liability”, and “General Provisions” will survive termination of this Agreement.
If any portion of these terms is held to be unenforceable, the unenforceable portion shall be construed in accordance with the Law of England and Wales to the extent that is possible. If any of the terms of this Agreement become or are declared to be illegal or otherwise unenforceable by any Court of competent jurisdiction, such term(s) shall be null and void and shall be deemed deleted from this Agreement. All remaining terms of this Agreement shall remain in full force and effect.
Unless otherwise specified, the Material on the Website is presented solely for the purpose of providing information about the School and its services. The School does not represent that the Material is appropriate or available for use in every country of the world. The User uses the Website at his/her own risk and is responsible for compliance with applicable local laws, keeping in mind that access to the Material may not be considered legal by certain persons or in certain countries.
Any claim the User may initiate with respect to this Website must be commenced within two years after the subject of the claim arises or such claim is barred. These terms will be governed by and construed in accordance with the laws of England and Wales without regard to its conflicts of law provisions. The waiver by the School of a breach of any provision of this Agreement will not be interpreted as a waiver of any other or subsequent breach.
